1. OBJECT

These terms and conditions define the rights and obligations of JADE ROLLER and the Customer regarding the products offered by JADE ROLLER on its website jade roller (hereinafter "the Site"). They apply exclusively between the company JADE ROLLER , 13 rue Sainte-Ursule, 31000 Toulouse, France (hereinafter "JADE ROLLER "), and any individual consumer visiting or making a purchase through the Site (hereinafter "the Customer").
On the Site, JADE ROLLER allows the Customer to order beauty products online (hereinafter "the Product(s)") in accordance with these terms and conditions.
Any order placed with JADE ROLLER therefore implies the Customer's unreserved acceptance of these terms and conditions. These terms and conditions may be modified at any time and without notice by JADE ROLLER ; the applicable terms and conditions are those in effect on the date the Customer places the order.

2. PRODUCTS AND COMPLIANCE

2.1. The Products offered for sale are presented on the JADE ROLLER and accompanied by a description.
2.2. The Products offered by JADE ROLLER comply with applicable French standards.
Elements such as photographs, texts, graphics, and all information and characteristics illustrating and/or accompanying the Products are not contractual, which the Customer acknowledges.
Consequently, JADE ROLLER cannot be held liable for any errors or omissions in any of these elements or for any modifications to said elements by suppliers and/or publishers.

3. CUSTOMER OBLIGATIONS

3.1. The Customer declares that they are of legal age and have the legal capacity or parental authorization to place an order on the Website.
3.2. The Customer agrees to provide JADE ROLLER with accurate and necessary information for the performance of the service covered by these terms and conditions, as requested online and according to their situation, including their full name, address, telephone number, and valid email address.
The Customer is responsible for the consequences arising from false or inaccurate information provided, or from the unlawful use of such information.
3.3. Once the order is placed, JADE ROLLER sends the Customer an email confirming it and informing them of the shipment of the Products.
3.4. The Customer can modify their information in the "My Account" section.

4. ORDER

4.1. All orders will only be validated after payment has been accepted.
4.2. JADE ROLLER reserves the right to cancel or refuse an order in the event of a dispute with the Customer regarding a previous order.
4.3. JADE ROLLER accepts orders subject to stock availability. The Customer is informed of the availability of the Products sold on the Website at the time of order confirmation.
If, despite JADE ROLLER , the products are unavailable, JADE ROLLER will inform the Customer by email as soon as possible. The Customer may then cancel their order and, if applicable, receive a refund of any sums already paid. ROLLER

5. PRICE

5.1. The prices displayed on the Website are in euros, inclusive of all French taxes (French VAT and any other applicable taxes), but excluding shipping costs, order processing fees, and packaging costs.
Shipping costs, order processing fees, and packaging costs will be shown in the Customer's shopping cart before final order confirmation.
The amount paid by the Customer does not include any taxes or customs duties that may be levied by customs authorities upon delivery to a country outside of France. The Customer is responsible for paying and understanding any applicable taxes and duties. JADE ROLLER is not liable for, and will not reimburse, any customs duties or taxes applicable to the Customer's country. If the Customer chooses not to pay import duties and returns the package, they will not receive a refund upon receipt of the package, but rather a credit on the Website for the value of the Products purchased only, less shipping costs.
Prices are subject to change at any time without notice, particularly in the event of changes to tax or economic data. Items will be billed based on the rates in effect at the time the order is placed.

6. DELIVERY

6.1. JADE ROLLER delivers its Products in France and all countries of the European Union and can even deliver internationally.
Products are shipped to the delivery address indicated by the Customer when placing their order. The delivery times indicated on the website are estimates, corresponding to average processing and delivery times. In order for these times to be met, the Customer must ensure that they have provided accurate and complete information regarding the delivery address (such as, in particular: street number, building number, floor, access codes, names and/or intercom numbers, etc.).
In the event of a delivery delay of more than 116 business hours, if the product has not been shipped, the Customer may cancel the order by email to contact@jade roller with read receipt or by registered letter with acknowledgment of receipt and request a refund.
If the item was shipped before receipt of the order cancellation due to a delivery delay exceeding 116 business hours, JADE ROLLER will refund the item and the shipping and return costs upon receipt of the item, complete, in its original condition, and with all tags attached.
JADE ROLLER is committed to keeping the Customer informed of the progress of their order.
In the event of damaged packages (already opened, missing items, etc.), the Customer agrees to notify the carrier and JADE ROLLER of any issues within 3 days of receiving the product.
JADE ROLLER cannot be held responsible for consequences due to shipping delays that are not its fault.

7. PAYMENT

Full payment is due at the time of order. Under no circumstances will payments be considered as deposits or down payments. The Customer pays for their order by credit card (Visa, Eurocard/Mastercard) or with their PayPal account. For each transaction, the Customer must provide the card number on the front of their card, the card's expiration date, and the security code on the back of the card (last three digits).
By providing their credit card number, the Customer authorizes JADE ROLLER to debit their account for the full amount of their order.
Cash on delivery shipments will not be accepted under any circumstances.
JADE ROLLER retains ownership of the item until the Customer has paid the full price. Purchases are made securely. The payment solutions used by JADE ROLLER are 100% secure. For payments by bank card (Carte Bleue, Carte Bleue Visa and e-Carte Bleue), all information that Customers provide to JADE ROLLER is strictly protected and guarantees the compliance and security of each transaction.

8. RETURN AND REFUND OF PRODUCT(S)

RIGHT OF WITHDRAWAL
Within thirty (30) days of receiving their order, the Customer may request a return of the Product(s) ROLLER
The Customer must return the Product(s) they wish to return at their own expense, unless the product has a manufacturing defect or does not correspond to the initial order. They must inform customer service by email at sav@jade roller or complete the online return form on the "Delivery and Returns" page of the Website, which contains all the instructions for returning the Product(s). If the Customer receives a product with a manufacturing defect or that does not correspond to the initial order, they may notify customer service at sav@jade roller to be reimbursed for the return shipping costs. A prepaid return label service will generally be offered.
The return is at the Customer's risk. The Product must be returned in its original packaging, in its original condition, new, unused, and accompanied by the order number, to the following address:

The returned Product will be credited or refunded within a maximum of fifteen (15) days of its receipt by JADE ROLLER . In the case of a refund, the amount to be refunded will be credited to the Customer's bank account.
If the Customer fails to comply with these conditions, particularly the return or exchange conditions, JADE ROLLER will not be able to refund the Products in question.

9. COMMERCIAL WARRANTY

All our products are guaranteed for one year from the date of purchase.
In accordance with Article L211-4 of the French Consumer Code, JADE ROLLER undertakes to deliver the product(s) free from defects in conformity. This guarantee does not apply: (a) to stone or glass parts, unless the damage is due to a defect in materials or workmanship; (b) to cosmetic damage, including but not limited to scratches, scuffs, or breakage, unless the damage is due to a defect in materials or workmanship; (c) to damage caused by accident, misuse, abuse, exposure to liquid, fire, earthquake, or any other external cause; (d) to a defective product resulting from use not in accordance with its intended purpose or from improper use; (e) to defects resulting from normal wear and tear or the normal aging of the product; (f) to theft or loss of part or all of the product. All costs incurred (shipping, replacement, repair) are the responsibility of the JADE ROLLER in accordance with Article L211-11 of the French Consumer Code. 10. INTELLECTUAL PROPERTY

Under no circumstances is the Customer authorized to download or modify all or part of the Site, including its content (listed products, descriptions, images, videos, etc.).
This Site, or any part thereof, may not be reproduced, copied, sold, or exploited for commercial purposes without the express written authorization of JADE ROLLER .
Generally, all copyrights, trademarks, and other distinctive signs and proprietary or intellectual property rights appearing on the Site remain the full and exclusive property of JADE ROLLER .
The Customer is therefore obligated to respect these intellectual property rights and may not use the trademarks appearing on the Site and on the Products, if applicable, or register any trademark that would infringe upon the rights holder, unless otherwise stipulated in a contract.
The same applies to all other intellectual property rights.

11. GUARANTEES AND LIABILITY

JADE ROLLER is only bound by an obligation of means for all stages of access to the website, from the ordering process to the shipment of the package and subsequent services. JADE ROLLER cannot be held liable for any inconvenience or damage inherent to the use of the internet, including service interruptions, external intrusions, or the presence of computer viruses, or for any event considered force majeure, in accordance with the law and case law.
JADE ROLLER undertakes to use Customers' confidential information only for the operation of its Website.
For the proper processing of the order, the personal data collected will be subject to computer processing, and the Customer acknowledges being aware of this.
As such, information concerning the Customer may be communicated to JADE ROLLER .
Furthermore, JADE ROLLER may use technical means to obtain non-personal information relating to internet users in order to improve the website's functionality, for example, by tracking the number of visitors to certain pages.
In accordance with the law of 6 January 1978, as amended by the law of 6 August 2004, the Customer has the right to access and rectify personal data concerning them held in JADE ROLLER . All requests must be sent by email to: contact@jade roller .

12. FORCEEURE

In the event of force majeure, the affected party must notify the other party within fifteen (15) days of the occurrence of such event, by registered letter with acknowledgment of receipt.
Specifically, the following are considered force majeure or fortuitous events, in addition to those usually recognized by French courts: total or partial strikes, lockouts, riots, boycotts or other industrial actions or commercial disputes, civil unrest, insurrection, war, severe weather, epidemics, blockages of transportation or supply routes for any reason whatsoever, earthquakes, fires, storms, floods, water damage, governmental or legal restrictions, legal or regulatory changes to marketing methods, computer failures, telecommunications outages, including wired or wireless telecommunications networks, and any other event beyond the control of the parties that prevents the normal performance of the contractual relationship.
All obligations of the parties will be suspended for the entire duration of the force majeure event, without compensation.
If the force majeure event continues for more than three (3) months, the contract in question may be terminated automatically without compensation for either party.

13. GENERAL PROVISIONS

13.1. PARTIAL INVALIDITY OF A CLAUSE
If any provision of these terms and conditions is declared invalid or unenforceable by a court of competent jurisdiction, it shall be deemed unwritten and shall not invalidate the other provisions.
13.2. UPDATES
These terms and conditions may be modified at any time and without notice by JADE ROLLER , the applicable terms and conditions being those in effect on the date of the order by the Customer.
13.3. GOVERNING LAW – JURISDICTION
These terms and conditions are governed by French law, both substantively and procedurally. Any dispute must first be subject to an attempt at amicable settlement.
In the absence of an amicable settlement, jurisdiction is conferred upon the competent French courts, notwithstanding multiple defendants or third-party claims.
13.4. REPRODUCTION OF APPLICABLE TEXTS (ORDINANCE 2005-136 OF FEBRUARY 17, 2005, CONSUMER CODE, CIVIL CODE)
Art. L. 211-4 of the Consumer Code:
The seller is required to deliver goods that conform to the contract and is liable for any lack of conformity existing at the time of delivery. The seller is also liable for any lack of conformity resulting from the packaging, assembly instructions, or installation when the latter was the seller's responsibility under the contract or was carried out under the seller's supervision.
Art. L. 211-5 of the Consumer Code
: To conform to the contract, the goods must:
1° Be fit for the purpose for which goods of the same type are normally used and, where applicable:
– correspond to the description given by the seller and possess the qualities that the seller presented to the customer in the form of a sample or model;
– possess the qualities that a Customer may legitimately expect, given the public statements made by the seller, the producer, or their representative, particularly in advertising or labeling;
2° Or possess the characteristics defined by mutual agreement between the parties or be suitable for any specific purpose sought by the Customer, made known to the seller, and accepted by the latter.
Art. L. 211-12 of the Consumer Code.
The action resulting from a lack of conformity is time-barred two years from the delivery of the goods.
Art. 1641 of the Civil Code.
The seller is liable for hidden defects in the thing sold which render it unfit for its intended use, or which so diminish that use that the Customer would not have acquired it, or would have given only a lower price, if they had known of them.
Art. Article 1648, paragraph 1 of the Civil Code:
The action resulting from latent defects must be brought by the purchaser within two years from the discovery of the defect.
